1. A rule nisi is issued calling upon persons interested to appear and show cause, if any, to this Honourable Court on
MONDAY, 14 MARCH 2022 at 10h00 or so soon thereafter as counsel may be heard, as to why an order should not
be made in the following terms:
1.1 Declaring the dissolution of Nico's Boilermakers CC to be void in terms of section 83(4) of the Companies Act 71
of 2008, as amended;
1.2 Declaring that the assets of Nico's Boilermakers CC, if any, are no longer bona vacantia and are revested in Nico's
Boilermakers CC;
1.3 Declaring that the liabilities of Nico's Boilermakers CC immediately prior to its dissolution are revested in Nico's
Boilermakers CC;
1.4 Recommending to the Second Respondent that Bryan Neville Shaw and Enver Mohamed Motala be appointed as
liquidators of Nico's Boilermakers CC;
1.5 Directing the First Respondent to restore the name of Nico's Boilermakers CC to the register of companies;
1.6 That the costs of this application be costs in the winding up of Nico's Boilermakers CC on the scale as between
attorney and own client;
2. Service of this order is to be effected as follows:
2.1 On the First Respondent by email to corporatelegalservices@cipc.co.za;
2.2 On the Second Respondent by hand;
2.3 On the South African Revenue Service by hand;
2.4 By one publication in one edition of the Government Gazette; and

NOTICE IN TERMS OF SECTION 39 OF THE PREVENTION OF ORGANISED CRIME ACT 121 OF 1998 (POCA)
The National Director of Public Prosecutions obtained a preservation of property order in the High Court of South Africa
(East London Circuit Local Division ) on 22 February 2022 under case number EL229/2022/ in relation to a cash
amount of R11 009.00 (which is the proceeds of unlawful activities). a copy of which can be obtained from the person
mentioned in para 9 hereunder .
This notice is addressed to Zakaria Odongo and all other persons who may have an interest in the property described
above.
Take notice that:
1. If you have an interest in the property, you should understand that it is now at risk. You are advised to obtain legal
advice on whether your interest can be protected and, if so, on how to protect it.
2. You are notified that the National Director will, within 90 days of publication of this notice, apply to the High Court
under section 48 of the POCA for a forfeiture order. The preservation order will remain in force until the application for
a forfeiture order is finalised, and until any forfeiture order that is made is satisfied.
3. If you intend to oppose the application for a forfeiture order, or you intend to apply for an order excluding your interest
from a forfeiture order in respect of the property, you must enter an appearance in terms of the order. The requirements
for such an appearance are set out in the order and are also dealt with in sections 39(3), (4) and (5) of the POCA. An
appearance must comply with these requirements.
4. Your attention is specifically drawn to the 14-day time limit prescribed in section 39(4) for the entry of an appearance
referred to in paragraph 3 above.
