HAVING read the documents filed of record, heard counsel, and considered the matter: IT IS ORDERED THAT:
1. A rule nisi is issued, returnable on 30 May 2022 calling upon all interested persons to show cause why the following
order should not be made final:
1.1 The resolution of 6 October 2021 by the first respondent placing itself in business rescue is set aside.
1.2 The business rescue of the first respondent is terminated.
1.3 The first respondent is wound up.
2. Pending the return day, the first respondent’s resolution of 6 October 2021 is set aside, its business rescue is
terminated and it is placed in provisional winding up.
3. A copy of this order is to be -
3.1 served on the first respondent at its registered address
3.2 served on every known trade union representing employees of the first
respondent if any,
3.3 served on the employees of the first respondent, if any, by affixing a copy of
this order to any notice board to which employees have access inside the first
respondent’s premises, or if there is no such notice board, by affixing a copy
to the front gate or front door of the premises of the first respondent.
3.4 served on SARS
3.5 published in the Government Gazette.
3.6 emailed or otherwise sent to every known policy holder potentially affected by
this order.
3.7 emailed or otherwise sent to all known creditors of the first respondent.

NOTICE IN TERMS OF SECTION 39 OF THE PREVENTION OF ORGANISED CRIME ACT 121 OF 1998 (POCA)
The National Director of Public Prosecutions obtained a preservation of property order in the High Court of South Africa
(Eastern Cape Local Division, Mthatha) on 15 December 2021 in case number 5433/2021 in relation to: In re: the credit
balance , including interest in the First National Bank account number 627 582 61 673 (the property) which is the
proceeds of fraud and theft.
This notice is addressed to Mawande Ignatius Zondi and all other persons who may have an interest in the property
described above.
Take notice that:
1. If you have an interest in the property, you should understand that it is now at risk. You are advised to obtain legal
advice on whether your interest can be protected and, if so, on how to protect it.
2. You are notified that the National Director will, within 90 days of publication of this notice, apply to the High Court
under section 48 of the POCA for a forfeiture order. The preservation order will remain in force until the application for
a forfeiture order is finalised, and until any forfeiture order that is made is satisfied.
3. If you intend to oppose the application for a forfeiture order, or you intend to apply for an order excluding your interest
from a forfeiture order in respect of the property, you must enter an appearance in terms of the order. The requirements
for such an appearance are set out in the order and are also dealt with in sections 39(3), (4) and (5) of the POCA. An
appearance must comply with these requirements.
4. Your attention is specifically drawn to the 14-day time limit prescribed in section 39(4) for the entry of an appearance
referred to in paragraph 3 above.
5. If you enter an appearance in terms of the order you will be entitled to be given 14 days notice of the application by
the applicant for a forfeiture order in respect of the property.
