            Notice for Change of Matrimonial Property Regime in terms of S21(1) of Act 88 of 1984
BE PLEASED TO TAKE NOTICE that an application will be made on behalf of the above-named Applicants on
3 November 2023 at 10h00, or as soon thereafter as counsel may be heard for an Order in the following terms:
1. That the Applicants are authorised in terms of Section 21(1) of the MATRIMONIAL PROPERTY ACT, 88 of
1984, to change their matrimonial property system from a marriage in community of property, to a marriage out of
community of property subject to the accrual system.
2. That Applicants are authorised to enter into a Notarial Contract, annexed hereto and marked “A”.
3. That Applicants are authorised and directed to lodge the above mentioned Postnuptial Contract with the Registrar
of Deeds, Cape Town, within three (3) months of the date of this Order.
4. That the Registrar of Deeds, Cape Town, be authorised and directed to register the Notarial Contract on condition
that it is lodged for registration within three (3) months of the date of this Order, and subject to compliance with all
relevant statutory provisions and Deeds Office requirements.
5. That the rights of pre-existing creditors of the Applicants’ joint estate shall be reserved in that Applicants shall
be held jointly and severally liable for all such debts incurred before the date of the registration of the Notarial
Contract.
6. That the Applicants are granted such further and/or alternative relief as this Honourable Court may see fit.
