NOTICE OF MOTION
KINDLY TAKE NOTICE THAT the abovementioned applicants intent to make application to the above Honourable
Court on 9th April 2024 at 10:00 or as soon thereafter as the matter may be heard for an order in the following
terms:
1. That condonation be granted for the late execution of the antenuptial contract concluded between the first and
second applicant on 27 October 2020, executed on 16 November 2020 and registered in the Deeds Registry No.
H3784/2020 on 26 November 2020, a copy of which is annexed hereto marked A1.
2. That the notarial contract registered in the Deeds Registry No. H3784/2020 on 26 November 2020, be declared
valid and of full force and effect retrospectively from the date of marriage, being 29 October 2020, in consequence
of which the marriage of the first and second applicant shall be governed by the terms of the said antenuptial
contract retrospectively from such date.
In the alternative to prayers 1 and 2 above
3. That leave be granted to the first and second applicants to change their matrimonial property system from a
marriage in community of property to a marriage out of community of property with the exclusion of the accrual
system.

4. That the first and second applicants be authorised to enter into a notarial contract in terms of the provisions of
the draft notarial contract annexed to the application as Annexure B.
