An order is granted in terms of the provisions of section 53 of the Prevention of Organised Crime Act, 121 of 1998
(POCA) declaring forfeit to the State a Volkswagen Jetta motor vehicle with Registration number CA230 983 and a
Jaguar FX motor vehicle with Registration number FB 50 WG GP that is subject to a preservation order dated 23
November 2023.
1. In terms of section 56 (2) of the POCA, the property shall vest in Dirk Johannes Hendrik Kotze (Kotze) an
auctioneer in the employ of Ikapa Express Auctions on behalf of the state upon granting of the forfeiture order.
2. Kotze is authorized to:
2.1 Assume control of the property;
2.2 sell the motor vehicles at best, by way of public auction or private treaty;
2.3 sign all documentation necessary to give effect to the sale, transfer, and the registration of the motor
vehicles;
2.4 subject to any order of this court for the exclusion of any interest in the property under section 52(2) of the
POCA, to deduct his/her fees and expenditure which were approved;
2.5 deposit the balance of the proceeds into the Criminal Assets Recovery Account established under section
63 of the POCA account number 80303056 held at the South African Reserve Bank.

2.6 perform any ancillary acts which, is subject to any directions of the Criminal Asset Recovery Committee
established under section 65 of the POCA that are necessary;
2.7 any person whose interest in the property concerned is affected by the forfeiture order, may within 20 days
after he or she has acquired knowledge of such order, set the matter down for variation or rescission by the Court;
2.8 Costs in the event of the application being opposed.

The National Director of Public Prosecutions applied for and was granted a preservation of property order in
terms of section 38 of the Prevention of Organized Crime Act, No. 121 of 1998 in the High Court of South Africa
(Gauteng Division, Johannesburg) on 19 April 2024 in Case number 2024/040687, in relation to:
The sum of R6 650 in the possession of Taneel Baisley and the sum of R7 810 in the possession of Pearl
Molokwane seized by the South African Police Service on 2 February 2020 under Randburg CAS 38/02/2020.
This notice is addressed to Pearl Molokwane and to Taneel Baisley and all other persons who have an
interest in the sums of R6 650 and R7 810 in cash seized by the South African Police Service on 2 February 2020
under Randburg CAS 38/02/2020 (the property).
Take notice that:
1. The National Director of Public Prosecutions (National Director) has obtained a preservation of property
order (the order) in terms of section 38(2) of the POCA in respect of the property.
2. If you have an interest in the property, you should understand that it is now at risk. You are advised to obtain
legal advice on whether your interest can be protected and, if so, on how to protect it.
