NOTICE OF MOTION
TAKE NOTICE THAT application will be made on behalf of the abovenamed Applicants on the 21 st JULY
2025 at 10h00 or so soon thereafter as counsel may be heard for an order in the following terms:
1. The Applicants are given leave to change the matrimonial property system which applies to their marriage,
by the execution and registration of a notarial contract, a draft whereof is attached to the First Applicant’s
affidavit in this application and is marked “X” and which contract, after registration thereof, will regulate their
property system.
2. The Registrar of Deeds is authorised and directed to register the notarial contract.
3. This order:
3.1 The notarial contract will be registered by the Registrar of Deeds within three (3) months from date of this
order of court; and
3.2 will not prejudice the rights of any creditor of the Applicants as at date of registration of the contract.
FURTHER TAKE NOTICE THAT the affidavit of KUHLE BUSHWANA and the confirmatory affidavits of
LUKHANYO BUSHWANA AND OREATLILE MASHITISHO together with the annexures thereto, will be used in
support of this application.
BE PLEASED TO TAKE FURTHER NOTICE THAT the First and Second Applicants have appointed
