                                       EX PARTE NOTICE OF MOTION
  BE PLEASED TO TAKE NOTICE that the abovementioned Applicants intend making Application to the above
Honourable Court on the 29th day of July 2025 at 10h00 or soon thereafter as Counsel may be heard, for an
Order in the following terms:
  1. That the existing Matrimonial Property System between the Applicants in terms of which they are married in
community of property shall no longer apply to their marriage;
   2. Authorising the Applicants, in terms of section 21(1) of the Matrimonial Property Act No. 887 of 1984, as
amended, to conclude a Postnuptial Notarial Contract, within three months of the granting of this Order, by which
their future Matrimonial Property Regime will be regulated and in accordance with the terms and conditions
contained in the draft Postnuptial Contract which constitutes Annexure "FA01" to the First Applicant's
Supporting affidavit;
  3. That the Registrar of Deeds, Cape Town, be authorised and requested to register the said Notarial Contract
upon fulfillment of his requirements and upon submission;
  4. Directing that the effect of this Order shall not prejudice the rights of any creditors of either of the
Applicants whose claim arose prior to the registration of the Postnuptial Contract;
  5. Granting the Applicants such further and/or alternative relief as this Honourable Court may deem
appropriate.
  TAKE NOTICE FURTHER THAT the Founding affidavit ofTAMMY SHEREE CARELSE together with the
supporting affidavit of
  ROCZAYE ROMEO CARELSE and the annexures thereto will be used in support of this Application.
   TAKE FURTHER NOTICE THAT a ny person who wishes to object to the proposed change in the Applicants
Matrimonial Property Regime, or to make any representations in this regard, can do so in writing to the Registrar
of the Western Cape High Court, Cape Town at Keerom Street, Cape Town and by sending a copy of the written
objection or representations to the Applicants Attorneys, Africa and Associates at 54 Argyle Street, Woodstock,
Cape Town or by appearing in court at 10h00 on the day of the hearing.
  AND TAKE NOTICE FURTHER THAT the Application and proposed Postnuptial Notarial Contract are
available for inspection at the offices of Applicants Attorneys as aforesaid.
