NOTICE IN TERMS OF SECTION 39 OF THE PREVENTION OF ORGANISED CRIME ACT, 121 OF 1998
(POCA)
The National Director of Public Prosecutions applied for and was granted a preservation of property order in
terms of section 38 of the Prevention of Organised Crime Act, No. 121 of 1998 in the High Court of South Africa
(Gauteng Division, Pretoria) on 12 March 2025 in case number 2025-025228, in relation to:
1. A Land Rover, Range Rover Sport motor vehicle with registration number DY15ZFGP chassis/VIN number
SALWA2EE3EA383272 and engine number 14060633155508PS seized by members of the South African Police
Service on 24 July 2024 under case docket Hartbeespoort Dam CAS 196/07/2024 and held at Brits Police Pound
with reference SAP 13/387/2024; and
2. A cash amount of R577 550.00 seized by members of the South African Police Service in the Hartbeespoort
policing area on 24 July 2024 under case docket Hartbeespoort Dam CAS 196/07/2024 kept in the SAPS
suspense account with reference number 0027 001587802. (a copy of the application and order can be obtained
from the person mentioned in par 9 hereunder.)
This notice is addressed to: 1) Steward Allen Bell whose last known address is number 21, Patric Road,
Kenmare, Krugersdorp, Johannesburg, Gauteng Province and all persons who may have an interest in the
property described above.
Take notice that:
1. If you have an interest in the property, you should understand that it is now at risk. You are advised to
obtain legal advice on whether your interest can be protected and, if so, on how to protect it.
2. You are notified that the National Director will, within 90 days of publication of this notice, apply to the High
Court under section 48 of the POCA for an forfeiture order. The preservation order will remain in force until the
application for a forfeiture order is finalised, and until any forfeiture order that is made is satisfied.
3. If you intend to oppose the application for a forfeiture order, or you intend to apply for an order excluding
your interest from a forfeiture order in respect of the property, you must enter an appearance in terms of the
Order. The requirements for such an appearance are set out in the Order and are also dealt with in sections
39(3), (4) and (5) of the Act. An appearance must comply with these requirements and must be delivered to the
office of the State Attorney at the address mentioned in paragraph 9, below.
4. Your attention is specifically drawn to the 14-day time limit prescribed in section 39(4) for the entry of an
appearance referred to in paragraph 3 above.
5. If you enter an appearance in terms of the Order you will be entitled to be given 14 days notice of the
application by the Applicant for a forfeiture order in respect of the property.
6. If you fail to enter an appearance in terms of the Order or to comply with the above requirements, you will
not be given notice of the application for a forfeiture order and you will not be entitled to appear at the hearing of
the application. In such a case the Court may grant a default order forfeiting the property to the State under
section 53 of the Act.
7. You may, on good cause shown (including the non-availability of any other suitable remedy to protect your
legitimate rights or interests), on 3 days notice in urgent instances and at least 7 days notice in other instances
to the applicant, and within 8 days of becoming aware of the Order, apply for reconsideration of the Order.
8. You are specifically advised that even if you intend to apply for reconsideration of the preservation order in
this case, you must in addition comply with paragraphs 4 and 5 above if you intend to oppose the forfeiture
application at a later date. Failure to do so can result in a forfeiture order being granted against the property by
default and without further notice to you.
9. Whenever this order states that you must deliver or serve any notice, affidavit or other process document
on the Applicant, you must deliver or serve them on the Applicant at the following addresses: THE STATE

IN AN APPLICATION FOR A FORFEITURE ORDER IN TERMS OF SECTION 48 OF THE PREVENTION
OF ORGANISED CRIME ACT, 121 OF 1998, AMENDED

Having read the documents filed of record and having heard counsel for the parties, it is hereby ordered:
1. An order is granted in terms of the provisions of section 50 of the Prevention of Organised Crime Act, 121
of 1998 ( the POCA), declaring forfeit to the State the following property which is presently subject to a
preservation of property order granted by this Honourable Court under the above case number on 22 February
2023 ( the property):
1.1 Portion 296 (a portion of portion 259) of the Farm Zuurfontein 33, Registration Division IR, Province of
Gauteng, measuring 8,2842 hectares, original Deed of Transfer T53055/1989, and current Deed of Transfer
T21579/2020, (“ Farm 33 Zuurfontein”);
1.2 R12 000 000 (twelve million Rand), currently held through a Bank guarantee as property representing the
property known as Holding 34 Beverley Agricultural Holdings, Registration Division JR, Province of Gauteng,
measuring 2,0325 hectares, original Deed of Transfer T10792/1943, with current Deed of Transfer being
T5688/2022 (“Erf 34 Beverley”).
2. In terms of sections 52 (1) and 52(2) and 52(4) of POCA, the interest of RIC Development (Pty) Ltd in the
property known as Holding 34 Beverley Agricultural Holdings, Registration Division JR, Province of Gauteng,
measuring 2,0325 hectares, original Deed of Transfer T10792/1943, with current Deed of Transfer being
T5688/2022 (“Erf 34 Beverley”), is excluded from the operation of the forfeiture order subject to RIC Development
(Pty) Ltd making a payment of R12 000 000 (twelve million Rand), currently held through a Bank guarantee as
property representing the property.
3. In terms of section 56(2) of the Act, the property shall vest in the State upon granting of this order.
4. Upon the expiration of a 45 day period after a notice of this order is published in the Government Gazette,
the Registrar of Deeds shall cause the property described as Portion 296 (a portion of portion 259) of the Farm
Zuurfontein 33, Registration Division IR, Province of Gauteng, measuring 8,2842 hectares, original Deed of
Transfer T53055/1989, and current Deed of Transfer T21579/2020, (“Farm 33 Zuurfontein”) to be transferred to
the Gauteng Department of Infrastructure Development on being presented with this order by the applicant.
5. RIC Development (Pty) Ltd shall on the coming into effect of this order cause the amount R12 000 000 to
be paid to the nominated account of the Gauteng Department of infrastructure Development being Standard Bank
Business Current account number 302284451;
6. The Gauteng Department of Infrastructure Development is hereby ordered to assume control of Portion 296
(a portion of portion 259) of the Farm Zuurfontein 33, Registration Division IR, Province of Gauteng, measuring
8,2842 hectares, original Deed of Transfer T53055/1989, and current Deed of Transfer T21579/2020, (“Farm 33
Zuurfontein”) on behalf of the Gauteng Provincial Government and take all steps necessary to have it transferred
to the Gauteng Provincial Government.
7. Any person whose interest in the property concerned is affected by the forfeiture order, may within 20 days
after he or she has acquired knowledge of such order, set the matter down for variation or rescission by the
court.
8. Any person affected by the forfeiture order, and who was entitled to receive notice of the application under
section 48(2) of POCA but who did not receive such notice, may within 45 days after the publication of the
notice of the forfeiture order in the Gazette, apply for an order under section 54 of POCA, excluding his or her
interest in the property, or varying the operation of the order in respect of the property.
9. No order as to costs.
