application in terms of Section 21 of Act 88 of 1984 for leave to change their Matrimonial Regime from one in
community of property to one out of community of property with the exclusion of the accrual system and for the
court to authorize them to register a postnuptial notarial contract.
Any objections or representations regarding the proposed change must be done in writing to the Registrar of
the High Court Gauteng Division, Pretoria and by sending a copy to Shyama Morar Attorneys C/O Barnard

NOTICE OF MOTION
KINDLY TAKE NOTICE application will be made on behalf of the abovementioned Applicants to the above
Honourable Court on Tuesday , the 28 TH day of MAY 2025 at 09h30 , or so soon thereafter as the matter may
be heard, for an Order in the following terms:
1. That the Applicants are authorised to amend the Antenuptial Contract H685/2022 concluded between them
on 15 June 2022 by the registration of a notarially executed agreement of amendment on the same terms as the
draft Notarial Agreement of Amendment attached to the Founding Affidavit and marked Annexure “DG4” (“the
Notarial Agreement of Amendment”).
2. The Registrar of Deeds: Eastern Cape at Qonce ( “the Registrar of Deeds”) is authorised to register the
Notarial Agreement of Amendment provided that it complies with the formal requirements for registration.
3. The Notarial Agreement of Amendment will, after registration thereof, regulate the matrimonial property
regime of the Applicants.
4. This order shall lapse if the Notarial Agreement of Amendment is not registered by the Registrar of Deeds
within 3 (THREE) months of the date of the granting of this order.
