NOTICE OF MOTION

TAKE NOTICE that application will be made on behalf of the abovenamed Applicants on the 31st day of
October 2025, at 09h30 or so soon thereafter as counsel may be heard for an order in the following terms:
1. That leave be granted to the Applicants, to register their ante- nuptial contract duly executed on the 18
May 2022, postnuptially, within a period of three (3) months from the date of this order.
2. That the terms of the matrimonial property regime to their marriage will be amended and regulated in
accordance with the terms and conditions contained in the ante-nuptial contract appended as "Annexure B"
3. That the Registrar of Deeds, Pietermaritzburg, is authorised and directed. in terms of section 88 of the
Deeds Registries Act 47 of 1937 (“the DRA”), read with Section 21(1) of the Matrimonial Property Act , 88 of
1984, to register the ante-nuptial contract, postnuptially and to affect any necessary consequential alterations
and / or deletions of any endorsements in the title deed(s) of any immovable property held in the name(s) of
the Applicants.
4. That the order shall not prejudice the rights of any actual or contingent creditors of the Applicants whose
rights accrued prior to the registration of the ante-nuptial notarial contract.
5. Granting the Applicants such further and/or alternative relief as the above Honourable Court may deem fit.
6. No order as to costs, save that the Applicants shall seek costs against any interested party that
unsuccessfully opposes this application.
TAKE NOTICE FURTHER that the affidavit of Mohammed Ismaeel Khan, further supported and confirmed by
Zahra Kader, will be used in support of this application.
TAKE NOTICE FURTHER that the applicant has appointed A S Kader Attorneys at the address set forth
below at which he will accept notice and service of all process, notices and pleadings in this application.
TAKE NOTICE FURTHER that the application papers and the supporting documents may be inspected at the
