            Notice is hereby given that it is the intention to apply for the issue of a CERTIFICATE OF REGISTERED
   TITLE IN LIEU OF A LOST DEED, T118659/2007, dated 31 August 2007 in favour of MISSION POINT TRADING
   65 PTY LTD REGISTRATION NO: 2006/035718/07 in respect of PORTION 162 OF ERF 315 POTCHINDUSTRIA

             Matrimonial Property System
             In The High Court of South Africa (Western Cape Division, Cape Town). Case No: 10576/24 In the ex
   parte application of Andrew John Stidworthy (Identity Number: 9003135261084), 1st Applicant, and Tessa Mary
   Stidworthy (Identity Number: 9010170323083), 2nd Applicant. BE PLEASED TO TAKE NOTICE THAT Applicants
   intend to bring an application before this honourable Court on 14 June 2024 at 10h00, or as soon thereafter as
   Counsel may be heard, for an order: 1. Declaring that the marital regime presently governing the marriage between
   the abovementioned parties, namely marriage in community of property, as being cancelled; 2. Granting First and
   Second Applicants authority in terms of the provisions of section 88 and section 89 of the Deeds Registry Act 47
   of 1937 (as amended) to execute a Notarial Contract having the effect of an Ante-Nuptial Contract in accordance
   with the terms of the Notarial Contract annexed hereto marked “SW2”; 3. In terms of section 21 of the Matrimonial
   Property Act 88 of 1984, directing that the marriage of First and Second Applicants shall retrospectively from the
   date of their marriage, being 21 December 2019, be governed by the terms of the aforesaid Notarial Contract; 4.
   Authorising the Registrar of Deeds, Cape Town to register the said Notarial Contract, upon fulfillment of his
   requirements and upon submission thereof within 3 months of the date upon which this order is issued; 5. Declaring
   that this order shall not affect the rights of any creditors of the Applicants’ joint estate arising between the date of
   marriage and the date of execution and that such creditors shall be entitled to execute against either or both of the
   Applicants’ assets in respect of debts incurred during their marriage prior to the registration of the Notarial Contract.
   6. Further and/or alternative relief. BE PLEASED TO TAKE NOTICE FURTHER that the affidavits of ANDREW
   JOHN STIDWORTHY, TESSA MARY STIDWORTHY and BERNHARD PETER WAUGH, filed herewith, will be
   used in support of this application. Further take note that any person who wishes to oppose this application, must
   by notice in writing notify the Registrar of the above-mentioned court and a copy must be sent to the Applicants'
   attorney at the address below or appear in court on the day of the hearing of the application. Further take note that
   the application as well as a copy of the Notarial Contract that the Applicants wish to register is available for
   inspection at the office of the Registrar of the abovementioned court as well as at the Applicants attorneys as set
