Take notice that on the 27th of October 2025 at 10h00 or so soon thereafter as the matter can be heard, the
abovementioned applicants will apply to the Gauteng Local Division of the High Court, Johannesburg, Pritchard
Street & Kruis Street, Johannesburg, for an order in the following terms:
1. The applicants are given leave to change the matrimonial property system which applies to their marriage,
by the execution and registration of a notarial contract, a draft whereof is attached to the first applicant's second
supplementary affidavit and is marked “C” and which contract, after registration thereof, will regulate their
property system;
2. The Registrar of Deeds is authorised to register the notarial contract;
3. This order -
3.1. shall lapse if the notarial contract is not registered by the Registrar of Deeds within three months of the
date of the granting of this order; and
3.2. shall not prejudice the rights of any creditor of the applicants as at date of registration of the contract.
Please take notice that the affidavits of Annah Bathabile Mosala and Khauhelo Abel Mosala will be used in
support of this application.

RULE NISI RETURN DATE
1. The rule nisi granted on 5 AUGUST 2025 and returnable on 09 SEPTEMBER 2025, is extended to 15
OCTOBER 2025, calling upon all interested parties to show cause why an order should not be made in the
following terms:
1.1 That the registration of the Sixth Respondent, a deregistered company known as EMACHUBENI
PROPERTIES (PTY) LTD, with registration number 202051943307, is restored in terms of Section 82(4) and
83(4)(a) of the Companies Act 71 of 2008 (“the Act”);
1.2 That the First Respondent be directed to restore the Sixth Respondent's name to the companies register;
1.3 It is declared that upon the restoration of the registration of the Sixth Respondent:
1.3.1 That the assets of the Sixth Respondent are no longer bona vacantia.
1.3.2 The assets of the Sixth Respondent will vest in the Sixth Respondent retrospectively to the date of de-
registration and as it the Sixth Respondent had not been deregistered;
1.3.3 All liabilities of the Sixth Respondent continue and may be enforced as against the Sixth Respondent in
respect to any existing or contemplated legal action.
1.4 That the Sixth and Seventh Respondent are to pay the costs of this application on the scale between
attorney and client.
2. The rule to be published once in the Government Gazette in English and an English Newspaper circulating
in Gauteng.
