                                               NOTICE OF MOTION
   KINDLY TAKE NOTICE THAT the Applicants intend to make an application to this Honourable Court on
_________________________ at 09:00 or as soon thereafter as the matter may be heard, for an order in the
following terms:
   1. That the Applicants be granted leave to change their matrimonial property regime and authorizing them in
terms of Section 21(1) of the Matrimonial Property Act, No. 88 of 1984, as amended, to conclude and register a
postnuptial notarial contract in terms whereof the matrimonial property regime applicable to their marriage be
altered and regulated in accordance with the terms and conditions contained in the draft postnuptial notarial
contract which constitutes annexure “F10” attached to the First Applicant's founding affidavit, which shall
operate from the date of execution thereof; with such contract, after registration thereof , to regulate their
property system;
   2. That the Applicants be ordered to register the abovementioned postnuptial notarial contract within THREE
(3) months from date of this order;
   3. That the Registrar of Deeds, Mbombela be authorized and directed to register the aforementioned notarial
contract and to effect any necessary consequential alterations and/or deletions of any endorsements in the title
deeds of any immovable property held in the names of either, or both, of the Applicants provided that the
abovementioned notarial contract complies with the legal requirements and subject to it being submitted to the
offices of the Registrar of Deeds within the period prescribed in paragraph 2 above;
  4. Confirming that this order shall not prejudice the rights of any actual or contingent creditors of the
Applicants whose rights accrued prior to the registration of the postnuptial notarial contract; and
  5. Further and/or alternative relief that this Honourable Court may deem fit to grant.
  TAKE NOTICE FURTHER THAT the affidavits of GILES FOURIE, JEANINE MICHELLE FOURIE and
DOUGLAS PETER HOLING will be used in support of this application.
