  AMENDED NOTICE OF MOTION
   TAKE NOTICE that Application will be made on behalf of the First and Second Applicants (“the Applicants”)
on the 19 th day of March 2026 at 10:00 am or so soon thereafter as Counsel may be heard for an order in the
following terms: -
   1. That leave is granted to the Applicants, in terms of Section 21(1) of the Matrimonial Property Act 88 of
1984, to change the matrimonial property system that applies to their marriage, by the execution and registration
of a notarial contract, a draft whereof is attached to the First Applicant's supporting affidavit and is marked
“NCT1”, and which, after registration thereof will regulate their property system.
  2. The Registrar of Deeds is authorized to register the notarial contract.
  3. This order:

  3.1 Shall lapse if the Registrar of Deeds, North Gauteng Deeds Registry, does not register the notarial
contract within (3) three months of the date of the granting of this order.
  3.2 Will not prejudice the rights of creditors of the Applicants' joint estate and that such creditors shall be
entitled to execute against the Applicants' assets in respect of debts incurred prior to the registration of the
Notarial Contract.
  4. Granting the Applicants such further or alternative relief.
