COURT ORDER
Having read the papers filed on record, heard Counsel for the Applicant and having considered the matter,
and: IT IS ORDERED THAT: 1. A rule nisi is issued returnable on 5 November 2024, why an order should not
be made in the following terms: 1.1. That the registration of the sixth respondent company known SHOLITZ
MANSIONS CC, a deregistered close corporation in terms of the Company Laws of the Republic of South
Africa with registration number 2005/161821/23 is restored in terms of Section 83(4)(a) read with Section 82(4)
of the Companies Act 71 of 2008 ("the Companies Act"); 1.2. That the First Respondent is to restore and
reinstate the Sixth Respondent's name in the register of Companies; 1.3. That it is declared that upon the
restoration of the registration of the Sixth Respondent: 1.3.1. The assets of the Sixth Respondent are no longer
bona vacantia; 1.3.2. The assets of the Sixth Respondent will vest in the Sixth Respondent with retrospective
effect to the date of deregistration and as if the Sixth Respondent had not been deregistered; 1.3.3. All liabilities
of the Sixth Respondent continue and may be enforced as against the Sixth, Seventh and Eighth Respondents,
whether in terms of existing and / or contemplated legal action; 1.4. That the Sixth and Seventh Respondents
are to pay the costs of this application on a scale as between attorney and client. 2. The rule is to be published
once in: 2.1 The Government Gazette in English and Afrikaans; 2.2 An English daily newspaper circulating in
